Google Pay API for Passes Terms of Service

Last modified: May 21, 2018

By using the Google Pay API for Passes (the "API"), you consent to be bound by these terms in addition to the Google APIs Terms of Service ("API ToS").

Content Policy

You may not use the API: (1) to promote or facilitate an unlawful transaction or the sale or exchange of any unlawful or prohibited goods or services, or (2) in violation of the Acceptable Use Policy. This Content Policy may be updated by Google and such updates will be made a part of these terms.

Submission of Content

The text under the "Submission of Content" heading in Section 5 of the API ToS will be deleted and replaced by the following:

Submission of Content. Some of our APIs allow the submission of content. Google may remove or refuse to display submitted content. Google does not acquire any ownership of any intellectual property rights in the content that you submit to our APIs through your API Client, except as expressly provided in these terms. By submitting, posting or displaying content to or from the APIs through your API Client, you give Google a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to use, host, store, reproduce, adapt, modify, create derivative works, communicate, translate, publish, publicly perform, publicly display and distribute such content. However, Google will only use such content for purposes of enabling Google to provide and improve the APIs and Google services, tailor content for end users, and in accordance with the applicable Google privacy policies. Before you submit content to our APIs through your API Client, ensure that you have the necessary rights (including the necessary rights from your end users) to grant us the license. Content submitted by you may include your Brand Features or another party's Brand Features (such as your customer's Brand Features if you are an aggregator). You will indemnify, defend, and hold Google harmless from and against any third party claim arising from any content or data routed into the APIs by you.

Brand Features; Attribution

Under the "Attribution" heading in Section 6 of the API ToS, the sentence "In using Google's Brand Features, you must follow the Google Brand Features Use Guidelines" will be deleted and replaced by the following:

"In using Google's Brand Features, you must follow the Google Brand Features Use Guidelines and the Google Pay Brand Guidelines."

Aggregators

If you are an aggregator of content, you warrant that you are authorized to submit content to Google on behalf of other parties. You will be solely responsible to Google for any content submitted through the Google Pay API for Passes.

End User Information

In the event an end user chooses to share information with you through the API ("End User Information"), or you receive a signal indicating that a given Google Pay pass has been added or removed from an end user's Google Account, you are solely responsible for ensuring that your use of such information complies with your privacy policy, data security policy, terms and conditions, and applicable law. You will indemnify, defend, and hold Google harmless from and against any third party claim arising from your use of such information. If an end user does not opt-in to receiving solicitation materials to their email address, you agree to honor such end user's solicitation preferences. You will indemnify, defend, and hold Google harmless from and against any third party claim arising from your failure to honor an end user's solicitation preferences. For the avoidance of doubt, End User Information includes (i) any information that directly or indirectly identifies a natural person; or (ii) information that is not specifically about an identifiable individual but, when combined with other information, may directly or indirectly identify a natural person. Google may, in its reasonable discretion, request verification that is reasonably acceptable to Google of your compliance with these terms, including all privacy, data security, and data protection laws, directives, regulations, and rules in any jurisdiction applicable to You.
